General conditions and terms of trade

1. Scope of Application

For the business relations between OPOSSUM design and the customer, only these general conditions and terms of trade are valid. Adverse terms and conditions are only valid if OPOSSUM design expressly approves their validity in writing. Sales contracts only become valid upon confirmation of your order in writing or the actual shipping of the goods.

2. Prices

2.1. The prices which are listed at the time of your order on the product page apply. The prices are final prices inclusive of German VAT and all other price components. This excludes the shipping costs. These are collected separately for your order and are determined mainly by weight of the goods and the shipping method you choose. The shipping costs will also be indicated on the product page.. All prices are given in Euros (€). Our prices are quoted for each sales unit and do not include any eventual service costs (e.g. custom cutting)

Errors or technical mistakes in representing the prices in the web shop are excepted. Special offers are only good as long as supplies last.

Payments are possible as prepayment through bank transfer or PayPal and credit card through the PayPal platform. For payments via PayPal till an order amount of EUR 150,00 a fee of 3,25% is charged.

2.2. Customs

2.2.1. Each order placed through the website and delivered in your country outside of UE may be subject to possible taxes or fees by customs of the destination country.

2.2.2. These customs charges pertaining to the delivery of a product are to be paid by the end user and solely the end user’s responsibility.

2.2.3. OPOSSUM design is not required to verify or communicate any applicable taxes or related customs charges to end users. For further information,

we encourage end users to contact the relevant authorities in their own country.

General conditions

The following General Terms and Conditions (hereinafter referred to as General Terms and Conditions) also contain legal information about your rights under the regulations on distance selling and electronic commerce.


1. Contractual partner, conclusion of contract

The purchase contract is concluded with OPOSSUM design Heike Sinnig.

The presentation of the products in the online shop does not represent a legally binding offer, but rather a non-binding online catalog. You can first place our products in the shopping cart without obligation and correct your entries at any time before sending your binding order by using the information provided for this in the ordering process and use the correction aids explained. By clicking the “Buy” order button, you place a binding order for the goods contained in the shopping cart. Confirmation of receipt of your order will be sent by email immediately after sending the order and does not constitute acceptance of the contract. We can accept your order by sending a declaration of acceptance in a separate email or by delivering the goods within 2 days.

If you have chosen cash on delivery, the contract is concluded upon delivery and thus payment of the invoice amount by cash on delivery.

The language available for concluding the contract is German.

We save the contract text and send you the order details and our general terms and conditions by email. You can view and download the terms and conditions here on this page at any time.

2. Order process

2.1 You order in our shop by

2.1.1 Add item to shopping cart

2.1.2 proceed to checkout

2.1.3 log in with your customer data or create a new customer account or continue the ordering process without creating a customer account by entering your name and contact details

2.1.4 select the payment method and enter your payment details

2.1.5 take note of our general terms and conditions and confirm them

2.1.6 confirm that you have been informed about the early expiry of your right of withdrawal and agree to this

2.1.7 confirm the accuracy of your information by clicking on the “Buy” button at the end.

2.2 Correction of input errors

You can correct the contractual declaration you made as part of the order at any time before sending by clicking on the "Edit" button or in the change fields displayed. After sending the order, corrections are no longer possible. In this case, please contact us immediately.

3. Delivery conditions

In addition to the stated product prices, shipping costs may be added depending on the amount of the order. You can find out more about the shipping costs under Shipping

We only deliver by mail. Picking up the goods yourself is only possible after prior arrangement.

4. Payment

The following payment methods are available in our shop:

Payment in advance with a 3% discount

If you pay in advance, transfer the entire amount minus a 3% discount in advance to our account specified in the confirmation email.

When completing the transfer, please make sure to include your name and/or the order number as the intended purpose. This makes it easier for us to assign payment to your order.

There are no fees for you.

(For payments from abroad, fees may apply which will be borne by you.)

Cash on delivery (Germany, Austria, Belgium, Netherlands, Luxembourg, Czech Republic, Hungary)

Pay conveniently and securely by cash on delivery upon receipt of the goods.

From an order value of 300 euros, the cash on delivery fee of 6.90 euros is waived.

(For payments from abroad, fees may apply which will be borne by you.)

PayPal with buyer protection

As a PayPal member, you can pay for your purchase conveniently, quickly and securely with PayPal. To pay with PayPal you need your own PayPal account. Normally we receive an immediate payment confirmation and can therefore ship your goods quickly.

Purchase on account (only in Germany, billing address is delivery address, maximum order value: 300.00 euros)

You pay for the goods after receiving them within 10 days of receiving the goods. Delivery of the goods to the customer or a person authorized to receive them is deemed to be receipt of the goods. If you have given the delivery company permission to leave the item at a desired location, the delivery is deemed to have been properly deposited at the desired location.

You will receive the payment information by email using the order confirmation and with the invoice enclosed with the shipment (on the outside of the package in a shipping bag). Your advantage: Your package will be sent immediately, you only pay after receiving the goods.

There are no additional fees. Delivery to an alternative delivery address is not possible here.

Direct debit with PayPal and buyer protection (only in Germany)

We offer you a convenient and secure way to pay by direct debit via PayPal Plus. You do not need your own PayPal account to pay by direct debit!

Your data will be transferred securely and will not be stored by us. When paying by direct debit via PayPal, PayPal buyer protection is included for you!

Credit card payment with PayPal and buyer protection

PayPal Plus gives you the convenient and secure option to pay by credit card. You don't need your own PayPal account to pay by credit card!

5. Right of withdrawal

Consumers have the statutory right of cancellation as described in the cancellation policy. You can find further information under “Right of withdrawal”.

Entrepreneurs are not granted a voluntary right of withdrawal.


6. Consequences of revocation

If you cancel this contract, we will refund to you all payments received from you, including delivery costs (except for any additional costs arising from you choosing a method of delivery other than the cheapest standard delivery offered by us have) to be repaid immediately and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this repayment we use the same payment method that you used for the original transaction, unless something different was expressly agreed with you; under no circumstances will you be charged any fees as a result of this repayment. We may refuse repayment until we have received the goods back or until you have provided evidence that you have sent the goods back, whichever is the earlier.

You are only liable for any loss in value of the goods if this loss in value is due to the handling other than what is necessary to establish the nature, characteristics and functionality of the goods.

For consumers within the meaning of 13 BGB, the following applies to returns within Germany:

You can organize the return shipment yourself at your own expense with a parcel company of your choice or you can instruct us to collect it.

If you place an order with us, the collection will be carried out by DPD or a shipping company, depending on the type of goods. You will be informed about the costs in advance by email. The costs depend on the number of packages and their respective weight and will be deducted from the reimbursement costs.

If DPD collects the item, you will be informed in advance by email about the collection date by DPD.

To ensure safe returns, we recommend that you use the original packaging and pack the goods carefully.

7. Out-of-court online dispute resolution

8. Warranty and Liability

All items delivered by us as part of your order are covered by a statutory warranty of 2 years. (For warranty conditions, see also Guarantee/Warranty of the Lower Saxony Consumer Center

Unless expressly agreed otherwise below, the statutory liability law applies. If the instructions for use listed in the operating instructions are not followed or if the goods are modified or used for purposes other than their intended purpose, the right to liability for defects expires.

For consumers, the limitation period for claims for defects for used items is one year from delivery of the goods, and for new goods it is 2 years from delivery of the goods.

The goods must be checked for visible defects immediately upon receipt. Visible defects must be reported to us in writing within 8 days of receipt of the goods.

Parcel shipping is insured, unless excluded in the shipping method chosen. Any transport damage must be reported to us in writing within 4 days of receipt of the goods. Subsequent complaints in this regard will not be accepted.

For entrepreneurs, the limitation period for claims for defects is one year from the transfer of risk; The statutory limitation periods for the right of recourse according to 478 BGB remain unaffected.

For entrepreneurs, only our own information and the manufacturer's product descriptions, which were included in the contract, are deemed to be an agreement regarding the quality of the goods; We assume no liability for public statements made by the manufacturer or other advertising statements.

If the delivered item is defective, we will first provide a warranty to entrepreneurs at our discretion by eliminating the defect (repair) or by delivering a defect-free item (replacement delivery).

8.1 We are fully liable in accordance with the statutory provisions for damage to life, body and health resulting from a negligent or intentional breach of duty on our part, as well as for damage covered by liability under the Product Liability Act. We are liable in accordance with the statutory provisions for damages that are not covered by sentence 1 and that are based on intentional or grossly negligent breaches of contract as well as fraudulent behavior on our part. We are only liable for damage that is due to the lack of guaranteed quality but does not occur directly on the goods if the risk of such damage is clearly covered by the quality guarantee.

8.2 We are also liable for damage caused by simple negligence, insofar as the resulting damage is due to the violation of rights that are to be granted to the customer according to the content and purpose of the contract and/or to the violation of obligations whose fulfillment is the enable proper execution of the contract in the first place and on compliance with which the contractual partner regularly trusts and may trust (cardinal obligations).

8.3 All warranties and further liability are void,

-if our products are not assembled in accordance with our assembly and installation instructions

-if other accessories are used

-if our products are handled improperly.

8.4 Any further liability is excluded regardless of the legal nature of the asserted claim.

OPOSSUMdesign creates links to other websites for informational purposes. These links do not represent any acknowledgment by OPOSSUMdesign of the content contained therein. OPOSSUMdesign is not responsible for the content of the linked third-party websites and does not guarantee the accuracy of the material made available there. Visiting these websites is your own responsibility.


10. Privacy Policy

All user information will be used exclusively in accordance with the provisions of our data protection declaration in accordance with the GDPR, which you can view under data protection.

11. Final provisions

11.1 The law of the Federal Republic of Germany applies exclusively, excluding the United Nations Convention on Contracts for the International Sale of Goods, unless the protection granted by mandatory provisions of the law of the country in which the customer, who is a consumer, has his habitual residence is withdrawn.

11.2 For contracts with merchants in the sense of Gera is the exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship.
